1675 Will of Edward Penney

Gentleman

 

In the Name of God Amen I Edward Penney the younger of Yeovell in the Countie of Somerset gent being of sound mynd and memorie Praise be given to God doe make and ordaine this my last Will and Testament in manner following (that is to say) First I commend my Soule into the hands of Almightie God trusting through the merits Death and passion of my alone Saviour Jesus Christ to have full and perfect remission and forgiveness of all my Synns and everlasting and eternall life that [inherit ?] in heaven And my Bodie I commit to the Earth to be buried and layd by my Executrix hereof in the Parish Church of Bradford as neare as conveniently it may to the Grave of my deare Mother And as touching all such temporall Estate as it hath pleased Almightie God to bestowe upon mee I give and dispose as followeth First I give and bequeath unto my deare wife Agnes Penney my dear Sister Edith Manyford widdowe my loving Kinsman Francis Coles the elder of Downton in the Countie of Wilts gent my loving Kinsman Henry Lewen of Wimborne in the Countie of Dorset gent and my loving friend Walter Foy of Yeovell aforesaid gent and to the Survivour and Survivours of them and the Heires and assignes of the Survivour and Survivours of them All that my third part (in three parts to be divided) of and in the Mannor or Lordshipp of Charlton Marshall with the appurtenances in the said Countie of Dorset And alsoe all that my third part (in three parts to be divided) of and in one Messuage or Farme with severall Lands Tenements and hereditaments thereunto belonging scituate lying and being in Charlton Marshall aforesaid And above all that my third part (in three parts to be divided) of and in Seveall messuages cottages Lands tenements and hereditaments belonging to the said Mannor Lordshipp or Farme to be Sold and the money thereby to be raised by the Sale thereof to pay in the first place unto my said loving Kinsman Francis Coles all such summe and summes of money as shall be owing unto him at the tyme of my death upon a certaine Mortgage which I formerly made unto him on other my lands and Tenements lying and being in the Parish of Beere Hacket in the Countie of Dorset and in the Parish of Barwick and Burrowe of Stoford in the Countie of Somerset And after their satisfaction thereof It is my will that the [surplus ?] thereof shall goe towards the Payment of all other my owne just and proper Debts (not those for which I Stand bound as Securitie) as I shall justly owe unto any other person or persons whatsoever at the time of my decease: Item I give and bequeath unto my deare wife Agnes Penney during her life All those my messuages Cottages Mills Lands Tenements and hereditaments whatsoever Scituate lying and being in the Parish of Barwick and Burrowe of Stoford in the Countie of Somerset And all those my Lands meadowes pastures Commons Copices tenem[en]ts and hereditam[en]ts whatsoever Scituate lying and being in the Parishes Villages Hamlets Fields Mannor or [precincts ?] of Beere Hacket Alcroft Beere-Hay Kingston and Lillington in the said Countie of Dorset And from and immediately after the decease of my said wife that I give and bequeath the same messuages Cottages Mills Lands meadowes pastures Commons Copices tenements and hereditaments  with their and every of their appurtenances unto my Sonne Edward Penney and the Heires of his bodie lawfully to be begotten; And my will and meaning is that if my Sonne Edward shall happen to dye before hee shall attaine the Age of one and twentie yeares and leave noe issue lawfully begotten of his Bodie I then hereby give and bequeath all those the same messuages Cottages Mills Lands meadowes pastures Commons Copices tenements and hereditaments  of what kynd or nature soever with their and every of their appurtenances unto my said deare Sister Edith Maniford my kinsman Francis Coles and my friend Walter Foy their heires and assigns forever to be sould and the monyes thereby to be raised to goe towards the payment of all such of my owne just and proper Debts as shall remaine unpaid out of the monyes that shall be raised by the Sale of my Lands in Charlton aforesaid And afterwards to goe towards the Payment of a Debt or summe of three hundred pounds with interest unto Mrs Sarah Fitz James for which I stand bound unto her And of a Debt of fortie Pounds unto Thomas [Keate ?] for which I stand bound to him And of the Summe of One hundred pounds to my deare wife And all the rest and residue of the monyes thereby to be raised I doe hereby will and appoint shall be equally payd and divided to and amongst my Brother Jonathan Penney and my Sisters Jane Penney and Abigail Penney And I doe hereby nominate and appoint my dearest and loving wife Agnes Penney to be Executrix of this my last Will and testament In witness whereof I have hereunto set my Hand and Seale this eleaventh Day of December in the yeare of Our Lord One thousand six hundred seventy and five [a short sentence in Latin pertaining to the reign of Charles II]
