Samuel Daniell (3)

Banker of Yeovil

 

Born in Yeovil around 1750, Samuel Daniell (3) was the eldest of the three sons of Yeovil banker John Daniell the Elder (c1728-1797) and Elizabeth née Goodford (d1763). Samuel (3)'s siblings were Yeovil banker John Daniell the Younger (1758-1818) and George (1759-1822) who became a surgeon of Exeter, Devon.

On 24 November 1777, at St Mary Arches, Exeter, Devon, Samuel married Mellena (also recorded as Mellana and Melloni) Glass. She was the youngest of the four daughters of Thomas Glass (1709-1786) and Mary née Hodges (1714-1770) of Exeter, Devon. They had no issue.

Samuel Daniell (3) died on 6 June 1798 and was buried at St John's church on 18 June 1798.

The 1797 Will of Samuel Daniell (3)

 

This is the last Will and Testament of me Samuel Daniell of Yeovil in the County of Somerset Banker I give my Mansion House in Hendford in Yeovil afores[ai]d with the Outhouses Stables Courts Yards & Gardens to the same belonging and the three meadows adjoining (Subject to the Yearly Rent of twelve pounds to my Mother for her life) and also a certain Orchard in Yeovil aforesaid called Salthouse Orchard with the Garden or Nursery adjoining which Orchard I lately had in exchange of Mr John Ryall unto my Wife Melloni Daniell for her life in case she shall so long remain a Widow and continue to reside in and Occupy my said Mansion House Also I give unto my said Wife for and during the term of her natural life in case she shall so long remain a Widow and continue to reside in my said Mansion House as aforesaid the use but not the property of all my Plate China Linnen Household Goods Furniture Books Casks and Bottles (except such parts thereof as and herein after Specifically disposed of to the said Melleni Daniell she keeping such Goods Furniture Books my Mansion House and Outhouses adjoining Insured from Damage from Fire in some respectable Assurance Office in London And I direct that an Inventory of such Goods & Furniture and a Catalogue of such Books be made and taken and a Copy of it delivered to my Executors herein after named within a Fortnight after my decease and that my said Wife shall not be accountable for the necessary and common decay incident thereto I also give my said Wife my Horses Carriages Harness Hay Corn my Wine and other Liquors Coals Jewels Repeating Watch & Trinkets (except such parts thereof as are by this my Will Specifically bequeathed for her own use and benefit I also give my said Wife the Sum of two hundred Pounds [around £22,000 at today's value] to be paid her by my Executors herein after named as soon as I am dead I also give my said Wife during the Term of her natural life in case she shall so long remain a Widow and continue to reside in my said Mansion House one Annuity or Yearly Sum of Fifty Pounds for the payment of which I subject the Estate which I lately bought of Mr Thomas Hoskins now occupied by Mr Pester And Whereas I have received a Legacy of Three Thousand Pounds which my said Wife was (amongst other things) intitled to under the Will of her late Father Doctor Glass now I direct my Executors herein after named to return the same to my said Wife and which I hereby give her accordingly I give and devise the Lands which I purchased of the late Mr Helyar now Occupied by Edw[ar]d Curtis called Pennys Hill Potten Close [Werldon?] and the Meadows adjoining with my Close of Meadow or pasture called Male Close now Occupied by Mr Tho[ma]s Sharland in Yeovil aforesaid unto my Mother for her life I give unto my Mother the Sum of one hundred pounds to be paid to her as soon as I am dead To each of my Friends Mr Hutchings Mr Peter Daniell & Mr Haskins in remembrance of the many Years of good will & uninterupted confidence I give a Ring of the value of Fifty Pounds To my most respected and most esteemed Friend Mrs Maria Goodford of Yeovil aforesaid Widow if she shall be living at the time of my death I give and bequeath to her and her Assigns for ever my Estate of [Dunwear?] near Bridgewater in the County of Somerset aforesaid (now Occupied as Tenants by Miss Woodham and [Culverell?] with all Rights [word illegible] thereto belonging) I also give to the said Maria Goodford the Writing Desk Table or Escritoire with the Contents thereof which is in my Back Room & I direct that the Levy thereof shall be immediately delivered to her as soon as I am dead without any part of it having been unlocked or examined And my Will further is that if there is any balance due from the said Maria Goodford on her Account Current to the Yeovil Bank in which I am a partner or from her the said Maria Goodford to me on my Private Account Current I hereby declare it paid & the Debt Cancelled and the same shall not be called for or deemed by my Executors herein after named or by any Person acting for or by their direction the Debt having been [recused?] wholly for my Interest advantage & happiness I also give the said Maria Goodford the following Personal Trinkets my Gold Watch which she commonly wears which has the Letters [illegible] engraved on the outside case of it and the Crest Seal annexed to it my Gold Chain & Trinkets which she gave me & which are annexed to the Watch I commonly use which Watch was the late Mr Goodfords and I hereby direct that it shall be returned with the Chain and Seal to Mrs Goodford as soon as I am dead I also give her my Sleeve Buttons in which her Hair is platted my Gold Shirt Pin and the Pocket Case in which are Gold marked Instruments which she before gave me To my dear Young Friend Maria Goodford Ju[nio]r I give the Picture of her Mother painted by Cosway To the aforesaid Maria Goodford Jun[io]r my d[ea]r Young Friends Eliz & John Goodford I give each Fifty Pounds to be expended by their Mother in some Trinket as Remembrance of me which Sum of one hundred and fifty pounds I direct to be paid to Mrs Goodford afores[ai]d as soon as I am dead To my much valued Friend Emanuel Pester of Preston near Yeovil I give Forty Guineas to be expended in some token as a remembrance of me To my Servant Rebecca Read in case she shall live with me at the time of my death I give twenty pounds aver and above the Wages due to her I give and devise all and singular my Messuages Farms Lands Tenements & Hereditaments situate lying and being in the several parishes of Yeovil Mudford Preston East Coter Hardington Mandeville Barwick or elsewhere in the County of Somerset and Bradford Abbas in the County of Dorset Subject and without prejudice to the Estate and Interest in my Mansion House and Land in Yeovil herein before devised to my said Wife and to the life Estate in Penny's Hill Batten Close Morl Close the Meadows adjoining & Mill Close herein before devised to my said Mother and also my Estate at [word illegible] near Bridgewater herein before devised to Mrs Maria Goodford aforesaid unto Charles Hutchings Esq of Yeovil afores[ai]d and John Hookins Banker of Yeovil aforesaid To hold the same unto and to the use of them the said Charles Hutchings and John Hookins their Heirs and Assigns for ever upon the several rusts and for the Intents and purposes herein [erased = after?] mentioned and expressed and declared of and concerning the same (that is to say) In Trust that they the said Charles Hutchings and John Hookins do and shall as soon as conveniently may be after my decease either by sale of Mortgage of such part or parts of my said Real Estate (as they my Trustees shall in their discretion think proper) raise and levy such Sum or Sums of Money as may be necessary in providing a sufficient Fund in aid of my Personal Estate for effectually discharging any Sum or Sums of Money which may be due from me to any person or persons at the time of my decease and also for satisfying as well all and singular the Legacies and bequests contained in this my Will as also of all Sum and Sums of Money to which my Wife will be intitled to by virtue of certain Articles made on our Marriage in the event of her Surviving me without having any Child or Children living at the time of my decease in exoneration of my Estate in the Parish of East Coker which by Indenture of [Demise?] bearing date the 10th day of May 1782 I have pursuant to such Articles Subjected to the payment of Two thousand pounds and Interest on the Contingency aforesaid And it is my Will and meaning that the Receipt or Receipts of them my said Trustees shall be a good sufficient discharge for the Money by them received and that the Purchaser or Purchasors Mortgage or Mortgages shall not be obliged to see [space] to the application thereof or be answerable or accountable for any misapplication thereof And as for and concerning one Moiety or half part (the whole into two equal parts to be divided) of all and singular my Messuages Lands & Hereditaments which shall not be absolutely sold and disposed of under the Trusts in this my Will and the Equity of Redemption of such parts thereof as may be redeemable In Trust for and for the only proper use and benefit of my Brother John Daniell his Heirs and Assignes for ever And as for and concerning the other moiety or half part thereof In Trust for and for the only proper use and benefit of my Brother George Daniell his Heirs and Assignes for ever and to and for no other use intent or purpose whatsoever I give and bequeath all my Goods and Chattels Monies and Securities for Money Personal Estate and Effects whatsoever not hereinbefore by me disposed of (charged with the Payment of my Debts & Legacies) unto the said Charles Hutchings and John Hookins In Trust nevertheless for and for the only benefit of my two Brothers the said John Daniell & George Daniell in equal Shares and proportions And I make and appoint them the said Charles Hutchings and John Hookins Executors In Trust of this my last Will and Testament I give and devise unto them the said Charles Hutchings and John Hookins all Manors Messuages Lands Tenements & Heredit[ament]s Mortgaged to me in Fee with their and every of their rights members and appurtenances To hold the same unto the use of the said Charles Hutchings and John Hookins their Heirs and Assigns in order to enable them to receive or transfer such Mortgaged Estates And it is my Will and meaning that the said Charles Hutchings and John Hookins and each of them and their Heirs Executors Administrators & Assigns of each of them shall be charged and chargeable only for such Money as they shall respectively actually receive by virtue of the Trusts hereby in them reposed and that they or either of them shall not be answerable or accountable for the other of them or for the Acts Receipts Neglects or defaults the one of the other but each of them only for his own Acts Receipts Neglects or defaults neither shall they or either of them be answerable or accountably for any Bail Bank Broker or other person with whom or in whose hands any part of the said Effects shall or may be deposited or lodged for safe Custody or otherwise in the Execution of any of the aforesaid Trusts nor for the insufficiency or deficiency of any Security or Securities Stocks or Funds in or upon which the said Trust Money or any part thereof shall or may be placed or Invested nor for any other misfortune loss or damage which may happen in the Execution of the aforesaid Trusts or in relation thereto unless the same shall happen by or through their own wilful default respectively And also that they the said Trustees and Executors and each of them & the several and respective Heirs Executors Administrators & Assigns of them and each of them shall and may with and out of such Securities as shall come to their respective hands by virtue of the aforesaid Trusts deduct retain to and reimburse themselves respectively and also to allow to his Co-Trustee all Costs & Charges & Expences which they or either of them shall or may suffer expend disburse or be put unto in the Execution of the aforesaid Trusts or in Relation thereto And Whereas John Old Goodford late of Yeovil aforesaid Esquire deceased did in and by his last Will and testament in Writing bearing date the 13 day of April 1787 (amongst other devices and bequests therein contained) give and devise all and every the Freehold Manors Messuages Lands Tenements and Heredit[ament]s whatsoever situate lying and being in the said County or elsewhere which he was seized of or intitled unto either in Possession Reversion Remainder or expectancy charged as therein is mentioned (unto Edward Philips the Younger Esq (since deceased) and to me the said Samuel Daniell our Executors Adm[inistrato]rs and assigns for and during the term of one thousand Years to commence from the death of the said Testator upon such Trusts and to and for such Intents and purposes As therein Are mentioned And the said Testator did in and by his said Will give and bequeath all the rest and residue of his Monies and other Personal Estate (after payment of the Legacies therein given) unto the said Edward Philips and me the said Samuel Daniell our Executors & Adm[inistrato]rs Upon certain Trusts therein contained And the said Testator did in and by his said Will also give and devise unto the said Edward Philips and me the said Samuel Daniell our Heirs and Assigns all Messuages Lands & Hereditaments Mortgages to [being?] in Fee with their and every of their Appurt[enance]s To hold the same unto and to the use of us the said Edward Philips and Samuel Daniell our Heirs and Assigns in order to enable us to [word illegible] or transfer such mortgaged Estates and appointed the said Edward Philips and the said Samuel Daniell Executors of his said Will (which said Will was duly proved by us the Executors in the prerogative Court of the Archbishop of Canterbury and Whereas the said Edward Philips hath since departed this life whereby I am become the Surviving Trustee and Executor named in the said Will as aforesaid Now I do hereby appoint Maria Goodford of Yeovil aforesaid Widow and Relict of the said John Old Goodford deceased Executrix of the Residue of the Term of one thousand years and also of all such Goods Chattels and Monies Credits Estates and Effects as are vested in me as Executor or Residuary Legatee in Trust as aforesaid But nevertheless upon such Trusts as shall at the time of my decease be Subsisting of and concerning the same respectively under and by virtue of the said Will of the said John Old Goodford And I empower her the said Maria Goodford by any Deed or Deeds Writing or Writings Sealed and delivered in the presence of and attested by two or more Credible Witnesses from time to time to grant bargain sell alien release convey transfer or dispose of all such Mortgages Lands and Hereditaments as were vested in the said Testator in Fee or for any less Estate by way of Mortgage and which may at the time of my decease be remaining in me as Executor or Trustee as aforesaid and effectually as I am now enabled to do or might do if then living And from and immediately after the decease of the said Maria Goodford (in case she shall appoint no person or persons to succeed her in the said Trusts which I hereby authorize and empower her to do) I appoint Charles Hutchings and John Hookins aforesaid Executors of the Residue of the said Term of one thousand years and of all such Goods Chattels Monies Credits Estates and Effects as are vested in me as Executor or Residuary Legatee In Trust as aforesaid upon such of the same Trusts as shall be then Subsisting of and concerning the same respectively And I give and devise all such Messuages Lands and Heredit[ament]s as were in Mortgage to the said John Old Goodford and are vested in me under the said writed Will for any Estate of Freehold or Inheritance unto and to the use of the said Charles Hutchings and John Hookins their Heirs and Assigns for all my Estate therein Subject to such Equit of Redemption as the same Promisses respectively are or may be liable to and also Subject and without prejudice to the power or authority herein before given to the said Maria Goodford of and concerning the same and in all other respects I do hereby ratify and confirm my said Will In Witness whereof I the said Samuel Daniell have to this my last Will and testament contained in six Sheets of paper to the first second third fourth and fifth Sheets thereof set my Hand and to the sixth Sheet set my Hand and Seal this seventh day of April 1795

Whereas I Samuel Daniell of Yeovill in the County of Somerset Esq[ui]re have made and duly executed my last Will and Testament in Writing bearing date the seventh day of April one thousand seven hundred and ninety five Now I do hereby declare and direct this present Writing to be a Codicil to and taken as part of my Will and whereas since the making and publishing my said Will I have purchased of Mr Robert Leach the Fee of several pieces and parcels of Ground in the Parish of Yeovil aforesaid I do give and devise the same and all my Estate and Interest therein unto Charles Hutchings Esq[uir]e and John Hookins Banker (the Executors and Trustees named in my said Will) and Maria Goodford Widow of John Old Goodford Esquire deceased To hold to them the said Charles Hutchings John Hookins and Maria Goodford their Heirs and Assigns for ever to the like uses and upon the like Trusts as are expressed and declared in and by my said Will with respect to such of my Real Estates as are therein devised to the said Charles Hutchings and John Hookins And it being my Will and Intention that the said Maria Goodford shall be a Co-Trustee and Executor of my said Will with the said Charles Hutchings and John Hookins I do in pursuance of such Intention give and devise all such Real Estates which by my said Will I have devised to the said Charles Hutchings and John Hookins Upon the Trusts therein mentioned unto them the said Maria Goodford Charles Hutchings and John Hookins their Heirs and Assigns for ever Upon the Trusts and to and for the Intents and Purposes declared thereof in and by my said Will and to and for no other use intent or purpose whatsoever Also I give and bequeath my Residuary Personal Estate unto them the said Maria Goodford Charles Hutchings and John Hookins Upon the Trusts thereof declared in and by my said Will And I make and appoint them the said Maria Goodford Charles Hutchings and John Hookins joint Executors of my said last Will and Testament lastly I do hereby ratify and confirm all other the devises and bequests in my said Will contained except such as are become lapsed by the death of my Mother In Witness whereof I have hereunto set my Hand and Seal this first day of March in the Year of our Lord one thousand seven hundred and ninety seven
