1807 Sale of The Sun inn
The 1807 sale of the Sun Inn in Grope Lane
This is an indenture in my collection dated 2 August 1807 between Edmund Batten acting for Henry Lillington, and Mary Nossiter, for the sale of a property in Grope Lane (today's Wine Street) - the Sun Inn.
This Indenture
of three parts
made the second
day of August in
the forty
seventh year of
the reign of our
sovereign Lord
George the Third
by the Grace of

and Ireland King
Defender of the
Faith and in the
year of our Lord
one thousand
eight hundred
and seven
Between
Edmund Batten
of Yeovil in the
County of
Somerset
Gentleman of the
first part
Henry
Lillington
of the same
place Victualler
of the second
part and
Mary Nossiter
of the same
place Widow of
the third part
Whereas the said
Edmund Batten is
seized in fee
simple of the
Messuage
Dwellinghouse
and premises
hereinafter
described and
intended to be
hereby devised
In Trust
for the said
Henry Lillington
his heirs and
assigns and to
be conveyed and
disposed of as
he or they shall
direct or
appoint
And Whereas
the
said Henry
Lillington hath
applied to and
requested the
said Mary
Nossiter to lend
and advance him
the sum of two
hundred pounds
on the security
of a mortgage of
the said
Messuage or
Dwellinghouse
and premises
which the said
Mary Nossiter
hath consented
and agreed to do
Now this
Indenture
Witnesseth
that for and in
consideration of
the sum of
Two
hundred pounds
of lawful money
of the United
Kingdom of Great
Britain and
Ireland current
in Great Britain
to the said
Henry Lillington
in hand paid by
the said Mary
Nossiter at or
immediately
before the
sealing and
delivery of
these presents
the receipt
whereof he the
said Henry
Lillington doth
hereby
acknowledge and
thereof acquit
release and
discharge the
said Mary
Nossiter her
heirs executors
administrators
and assigns by
these presents
And also in
consideration of
the sum of five
shillings of
like lawful
money to the
said Edmund
Batten at the
same time paid
by the said Mary
Nossiter the
receipt of which
is hereby
acknowledged He
the said Edmund
Batten at the
special instance

and appointment

Henry Lillington
testified by his
being a party to
and executing
these presents

Dwellinghouse
Burgage and Inn
commonly called
or known by the
name or sign of
the Sun
situate and
being in Grope
lane within the
parish of Yeovil
aforesaid late
in the
possession of
the said Mary
Nossiter and now
in the
possession of
the said Henry
Lillington his
tenant or
tenants together
with all houses
outhouses
edifices
buildings
stables cellars
courtyards ways
paths passages
waters
watercourses
easements
profits
advantages and
appurtenances
whatsoever to to
the said
Messuage or
Dwellinghouse
and premises
belonging or in
any wise
appertaining or
now or at any
time heretofore
had held used
occupied
possessed or
enjoyed or
reputed deduced
taken or known
as or to be part
parcel or member
thereof or
belonging
thereto and the
reversion and
reversions
remainder and
remainders rents
issues and
profits hereof
and all the
estate right
title interest
property claim
and demand
whatsoever at
law and in
equity of them
the said Edmund
Batten and Henry
Lillington and
each of them of
in to and out of
the same
premises and
every part
thereof
To have and to
hold
the said
Messuage or
Dwellinghouse
Burgage and Inn
and all and
singular other
the premises
hereby devised
or mentioned and
intended so to
be and every
part thereof
with the
appurtenances
unto the said
Mary Nossiter
her executors
administrators
and assigns from
the day next
before the day
of the date of
these presents
for and during
and unto the
full end and
term of one
thousand years
from thereto and
next ensuing and
fully to be
complete and
ended without
impeachment of
or for any
manner of haste
Subject
nevertheless to
the proviso or
condition for
redemption of
the said
premises
hereinafter
contained
Yielding and
paying therefore
yearly and every
year during the
said term unto
the said Edmund
Batten his heirs
or assigns the
rent of a
peppercorn on
the twenty fifth
day of December
if the same be
lawfully
demanded
Provided always
and these
presents are
upon this
condition that
if the said
Henry Lillington
his heirs
executors
administrators
assigns do and
shall well and
truly pay or
cause to be paid
unto the said
Mary Nossiter
her executors
administrators
or assigns the
full sum of two
hundred pounds
with legal
interest for the
same of lawful
money current in
England on the
second day of
February next
ensuing the date
of these
presents without
any deduction or
abatement out of
the same or any
part thereof or
any amount or
[pretense?]
whatsoever then
from and after
such payment so
made these
presents and the
term and estate
hereby granted
and every clause
and thing herein
contained shall
cease determine
and be
absolutely void
to all intents
and purposes
whatsoever any
thing
hereinbefore
contained to the
contrary thereof
in any wise
notwithstanding
And
the said Edmund
Batten for
himself his
heirs executors
and
administrators
doth hereby
covenant promise
and agree to and
with the said
Mary Nossiter
her executors
administrators
or assigns that
he the said
Edmund Batten
hath not made
executed
committed
willingly or
knowingly
suffered any act
deed matter or
thing whatsoever
whereby or in
consequence
whereof the said
Messuage or
Dwellinghouse
and premises
here by devised
or mentioned so
to be or any
part thereof and
shall or may be
charged
impeached or
encumbered in
title estate or
otherwise
whatsoever
And
the said Henry
Lillington for
himself his
heirs executors
and
administrators
doth covenant
promise and
agree to and
with the said
Mary Nossiter
her executors
administrators
and assigns by
these presents
that he the said
Henry Lillington
his heirs
executors
administrators
or assigns shall
and will well
and truly pay or
cause to be paid
unto the said
Mary Nossiter
her executors
administrators
or assigns the
said principal
sum of two
hundred pounds
with legal
interest for the
same on the said

February next
ensuing the date
hereof according
to the purport
of the foregoing
proviso and the
true intent and
meaning of these
presents
And also
that in
case default
shall be made by
the said Henry
Lillington his
heirs executors
administrators
or assigns of or
in payment of
the said
principal sum of
two hundred
pounds and
interest or any
part thereof
contrary to the
true intent and
meaning of the
foregoing
proviso and
covenant for
payment of the
same it shall
and may be
lawful to and
for the said
Mary Nossiter
her executors
administrators
or assigns
peaceably and
quietly to enter
into and upon
and to have hold
occupy possess
and enjoy the
said Messuage or
Dwellinghouse
and premises
hereby devised
or intentioned
so to be and
every part
thereof with the
appurtenances
and the rents
issues and
profits thereof
to receive and
take to her and
their proper use
from thenceforth
for and during
all the residue
and remainder of
the said term of
one thousand
years therein
then to count
and unexpired
without any
careful let suit
interruptions
disturbance of
or by the said
Edmund Batten
and Henry
Lillington or
either of them
their or either
of their heirs
or assigns or
any other person
or persons
whatsoever
And further
that
from and after
default made in
payment of the
said principal
sum of two
hundred pounds
and Interest or
any part thereof
as aforesaid
they the said
Edmund Batten
and Henry
Lillington and
their respective
heirs and all
and every other
person and
persons having
or lawfully or
equitably
claiming or to
claim and estate
right title
trust or
interest at law
or in equity of
in to or out of
the said
Messuage or
Dwellinghouse
and premises
hereby devised
or intended so
to be or any
part thereof
shall and will
from time to
time and at all
times thereafter
on the request
of the said Mary
Nossiter her
executors
administrators
or assigns but
at the proper
costs and
charges of the
said Henry
Lillington his
heirs executors

administrators
make do
acknowledge levy
suffer and
execute or can
be or or promise
to be made done
acknowledged
levied and
executed all and
every such
further and
other lawful and
reasonable acts
deeds devices
conveyances
assurances in
the law
whatsoever for
the better and
more effectually
granting and
assuring the
said messuage or
Dwellinghouse
and premises
with the
appurtenances
unto the said
Mary Nossiter
her executors
administrators
and assigns for
and during all
the then residue
and remainder of
the said term of
one thousand
years which
shall be in the
said premises
then to come and
in expired freed
and discharged
of and from the
provision or
condition for
redemption
herein contained
and all other
power benefit
and equity of
redemption
whatsoever as by
the said Mary
Nossiter her
executors
administrators
or assigns or
her or their
Counsel in the
law shall be
reasonably and
lawfully devised
or devised and
required
And lastly
it is hereby
declared and
agreed by and
between the said
parties to these
presents That
all and every
person or
persons who is
or are possessed
of term or terms
of years of or
in the Messuage
or Dwellinghouse
and premises
hereby granted
and devised or
intended so to
be or any part
thereof (other
than and besides
the term
hereinbefore
granted) shall
from henceforth
stand and be
possessed of the
same term or
terms Interest
In Trust for the
said Mary
Nossiter her

administrators

the better and
more effectually
securing to her
and them the
payment of the
said principal
money and

advanced and
lent as
