1761 Will of Samuel Garland

Malster

 

In the Name of God Amen I Samuel Garland the Elder of Yeovil in the County of Somerset Malster Considering the Uncertainty of this Mortal life and being of Sound Mind Memory and Understanding blessed by Almighty God for the same Do make and publish this my last Will and Testament in manner and form following (that is to say) First I Give and Devise all my Freehold Lands and Tenements whatsoever whereof I shall dye Seized in Possession reversion or Remainder unto my Son Samuel Garland his Heirs and Assigns forever Also I give unto my Daughter Anne now the Wife of Ezekiel Wills the Sum of One hundred Sixty Five pounds to be paid her in Twelve Months after my Decease by my Executor hereinafter named he the said Ezekiel Wills first Securing the said One hundred Sixty five pounds to his Wife as my Son Samuel Shall reasonably advise Also I give unto my Daughter Elizabeth the Sum of Three hundred pounds to be paid her in Twelve Months after my Decease by my Executor hereinafter mentioned Also I give unto my Daughter Elizabeth All the Furniture of the Chamber be it of what Kind or Quality soever in which She Lodges together with my Clock Also my Will is that if either of the Legatees mentioned in this my last Will and Testament Shall Litigate or Dispute in Law any article herein contained I hereby revoke the Legacy and Give to that Person One shilling only in the stead thereof to be paid as above And Lastly as to the rest residue and remainder of my Goods Chattels and Personal Estate (not before disposed of) be they of what nature or Kind soever I give and bequeath the same to my Son Samuel Garland whom I hereby Appoint Sole Executor to this my last Will and Testament hereby revoking all former Will or Wills by me made In Witness whereof I have hereunto set my hand and seal the Second day of June in the first year of the Reign of our Sovereign Lord George the Third And in the year of Our Lord One thousand Seven hundred and Sixty one

Signed Sealed Published and declared by the above named Samuel Garland to be his last Will and testament in the presence of us who have hereunto Subscribed our Names as Witnesses in the presence of the testator

This Will was proved at London the Eighth day of September in the Year of our Lord One thousand Seven hundred and Sixty one before the Right Worshipful Edward Simpson Doctor of Laws Master Keeper Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Samuel garland the Son of the deceased and Sole Executor named in the said Will to whom Administration was Granted of all and Singular the Goods Chattels and Credits of the said deceased he having been first Sworn by Commission duly to Administer
