1779 will of Mary Alford

Spinster

 

In the Name of God Amen I Mary Alford of Yeovil but late of Winsham in the County of Somerset Spinster do hereby revoking all other former Wills by me made make this my last Will and Testament in manner following First I doe hereby give devise and bequeath unto Nathaniel Royse of Winsham aforesaid Clerk and Singular my Freehold Leasehold or Copyhold Messuages Lands Tenements and Hereditaments which I have in the several parishes of Winsham aforesaid or in Yeovil in the said County of Somerset To hold the same unto the said Nathaniel Royse his Heirs Executors and Administrators for and during all such Term and Terms of Years Interest and Estate as I shall have therein respectively at the time of my decease Upon Trust that he the said Nathaniel Royse his Heirs Executors and Administrators do and shall as soon after my death as conveniently may be by Auction or otherwise sell and dispose of the said Messuages Lands and Tenements for the most Money that can be had or gotten for them and the Money so arising by sale thereof together with all such other Moneys and Effects as I shall die possessed of do and shall apply and pay in such Manner and for and towards the discharge of my Debts and the Legacies hereinafter by me given and bequeathed provided always that in case any or either of the lives on which my said Messuages Lands or Tenements are made determinable shall happen to die after my decease and before the same is or are disposed of as aforesaid and it shall be deemed beneficial for the Sale thereof to full state the same by adding a now life or lives I do hereby impower the said Nathaniel Royse his Heirs Executors and Administrators to Purchase and Add such new life or lives and I do hereby charge the said several Estates in the first place with the repayment of all such Money and Interest as shall or may be expended by the said Nathaniel Royse his Heirs Executors or Administrators in or about the purchase of such life or lives of and in them respectively Also I give and bequeath unto my Kinsman John Hood of Hardington the Sum of two Shillings and Sixpence to be paid him weekly and every week by my Executor herein after named for and during the term of his natural life Also I give and bequeath to his Daughter Mary Hood the Sum of Four hundred pounds to be paid her when she shall arrive at the Age of Twenty one years with Interest for the same at and after the rate of Four pounds by the hundred for a Year to be computed from one year next after my decease and such Interest to be paid and applied by my said Executor unto the said Mary Hood for and towards her Education and Maintenance by two half Yearly payments Michaelmas and Lady day the first payment thereof to be made on such of the said days as shall first and next happen after such Interest shall become due as aforesaid Also I give unto Elizabeth [Kysing ?] Royse my God Daughter the sum of One hundred pounds Also I give and bequeath unto the two Children of Edward Whitely last of Chard in the County of Somerset and to his Sister Elizabeth Gregory Widow of Froom in the same County One hundred pounds to be equally divided between Edward Wheatley's two Children and Elizabeth Gregory their Aunt Also I give to Mrs Shew Wife of George Shew of Yeovil aforesaid Goldsmith Fifty pounds and to my servant that shall live with me at the time of my death five pounds all which said last mentioned Legacies I do hereby will and direct to be paid by my Executor to the respective persons entitled to receive the same at the end of one year next after my decease All the rest and residue of my Goods Chattels Monies Securities for Monies personal Estate and Effects not hereby given and bequeathed after payment of my Just Debts Funeral Expences Legacies and the said weekly Allowance unto the said John Hood I do hereby give and bequeath unto the said Nathaniel Royse his Executors or Administrators In Trust for and to and for the only proper use and advantage of the said Mary Hood her Executors Administrators and Assigns And I do hereby nominate constitute and appoint the said Nathaniel Royse whole and Sole Executor of this my Will And lastly it is my Will and I do hereby declare and direct that it shall and may be lawful to and for the said Nathaniel Royse his Executors or Administrators in the first place to deduct and reimburse him and themselves by and out of the said Trust premises and Effects all such Costs Charges and Expences as he or they shall necessarily expend or be put unto in and about the Execution of the Trusts hereby in him or them reposed and that he or they shall not be answerable for any more Moneys than shall come to his or their hands respectively nor for any that shall be casually lost and not Willfully In Witness hereof I have hereunto set my Hand and Seal this Seventeenth day of February One thousand Seven hundred and Seventy nine

Signed Sealed published and declared by the said Mary Alford the Testatrix as and for her last Will and testament containing two sheets of paper to each of which She has set her name and to the last thereof has affixed her Seal in the presence of us who have Signed our names as Witnesses thereto in her presence and in the presence of each other

This Will was proved at London the Twelfth day o April in the year of Our Lord One thousand Seven hundred and Seventy nine before the Right Worshipful Peter Calvert Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully Constituted by the Oath of the Reverend Nathaniel Royse Clerk the Sole Executor named in the said Will to whom Administration was granted of all and Singular the Goods Chattels and Credits of the deceased he having been first sworn by Commission duly to Administer
