1786 Will of Jane Daniell

of Yeovil

 

In the name of God Amen whereas I Jane Daniell daughter of William and Margaret Daniell deceased late of Yeovil in the County of Somerset being by the blessing of God in sound mind and memory do make this my last Will and Testament in manner and form following, that is to say, I desire that my Executors hereinafter named will see me decently interred in the burial place of my dear Father and Mother in Yeovil and I do hereby give devise and bequeath all my Estates Lands Tenements goods Chattles Hereditaments and premises and Effects whether real or personal unto my Cousins the Rev Mr William Blake of Crewkerne and John Moore Esq of West Coker in the County of Somerset their Heirs Executors Administrators and Assigns whome I hereby nominate and appoint as my Executors In trust for ever for the uses and purposes following First I empower them to call in any money I may have at interest sufficient to pay my funeral expences or any just demands any one may have on me which I desire may be paid in half a year after my decease or sooner together with mourning for my Brothers Two Guineas to the Rev Mr Howell and two guineas to my servant Mrs Sarah Beaton if living with me then to be bestowed by her in mourning or otherways as she likes I likewise give to my four Nephews and to my niece five Guineas each to be paid in twelve months after my decease likewise to my Niece Sarah Daniell I give all my wearing apparal with all my earrings and desire her to give such of it as is not worth her acceptance to such of my relations where it may be acceptable In memory of my Friendship I give to Mrs Reed Mrs Graham Mrs Collins Mrs Marshal Mrs Baker & Miss Moore one Guiney each for a Ring and also the same to Miss Susannah Ostler I give to my Nephew A'Court Daniell my Watch with all my Household furniture and linen which I have in my Dwellinghouse in Yeovil but it is my Will that my Brother Samuel Daniell shall have the use of the same during his natural life or as long as he shall have occasion for it there or elsewhere and he nor his heirs shall not be accountable to the said A'Court Daniell or his Heirs or Assigns for any wear or waste thereof I likewise give to my said Nephew and furniture I may have elsewhere but it is my Will that his Father and Mother shall enjoy the use of it as long as they shall have occasion for it and shall not be accountable to him his heirs or Assigns for any wear or waste thereof I likewise give to my said Nephew A'Court Daniell all my plate, China, Rings or any other valuable but it is my Will that my Brothers George and Samuel Daniell shall enjoy the use of it during their lives or as long as they shall chuse to keep it And I desire my aforesaid Executors will soon after my decease divide my said Plate &c between my said Brothers in equal shares between them and I do hereby authorize my aforesaid Executors the Rev Will[ia]m Blake and John Moore Esq[ui]re their Executors Heirs Administrators or Assigns In trust for ever to let from time to time all my Lands and Tenements what and wheresoever to such person or persons for such term not exceeding Seven and at such rent as they shall judge proper and to pay the rents issues and profits thereof after the necessary expenses for repair &c are deducted into the hands of my said Brothers George and Samuel Daniell in equal shares and proportions or to apply the same towards their maintenance during their natural lives respectively in equal shares and proportions except my Dwellinghouse which I now inhabit which I solely appropriate to the use and advantage of my Brother Samuel Daniell as long as he shall have occasion for it together with my House in Grope Lane with the Garden and Back Houseing belonging thereunto for his use and benefit during his natural life or as long as he shall have occasion for it and likewise my Garden in the Churchyard for the same term and also my orchard in Preston Lane called Long Close for the same term and it is my will that my Executors shall within six months after my decease purchase of the Portreeve of the Borough of Yeovil and add my Brother Samuel's life and fully state the aforesaid House in the said Borough which I now occupy called Portreeve Land that the expence of such purchase shall be paid out of the other part of my Effects I shall have at my decease And to my Brother George Daniell I give for his sole use and benefit my House called Grubhams which is now occupied by Mr Hancock during the time he shall have occasion for it And it is my Will that on the decease of either of my said Brothers George or Samuel Daniell that the Survivor of them shall then have the share of such deceased Brother and that such share shall be solely appropriated to the use and maintenance of such surviving Brother And after the several deceases of my said Brothers I give devise and bequeath my Lands called Inner Shortlands Churchway two Acres in Northover Field together with a field on Hinford Hill now rented by Mr William Symmonds Gardener unto my Nephew Peter Daniell his Heirs and Assigns for ever upon Condition that he pays to my Niece Miss Sarah Daniell the sum of Two hundred pounds & to Georgiana and Emma Daniell Daughters of my Nephew George Daniell the sum of ten guineas each and til my said Nephew Peter Daniell has paid the above Legacies of two hundred pounds to my Niece Sarah Daniell Ten Guineas to each to the said Daughters of my Nephew George Daniell my said Executors shall appropriate the produce and rents of the said Lands towards paying such Legacies til they are paid Item I give my Watch to my Nephew A'Court Daniell but it is my Will that my Brother Samuel Daniell shall have the use of it as long as he shall chuse to keep it Item I give the sum of Twenty guineas to my Cousin William Scammel to be paid him in two years after my decease or sooner if convenient to my Executors and after the decease of both my said brothers I give devise and bequeath all the rest and residue of my Lands Tenements Hereditaments Goods Chattels and Effects unto my Nephew A'Court Daniell youngest son of my Brother George Daniell unto him and his heirs for ever But subject to the payment on his coming into possession of one hundred pounds to each of his Brothers and to his Sister and likewise if my Brother Samuel Daniell should marry I give to each child born of such mariage One hundred pounds out of my said Lands And I do hereby in token of my esteem give unto my said Executors In trust five Guineas for a ring desiring them my said Executors William Blake and John Moore Eq to see this my will written in two sheets of Paper fulfilled In witness whereof I hereunto set my hand and seal the twenty seventh day of February 1786
