The 1819 will of Thomas Jesty

Sadler and Harness Maker

 

This is the last Will and Testament of me Thomas Jesty of Yeovil in the County of Somerset Sadler and harness maker I give devise and bequeath unto Robert Young of Chilton Cantelo in the County of Somerset Yeoman and my Nephew Robert Jesty of Woolcombe in the County of Dorset Yeoman all my Freehold dwellinghouse stable Garden and Premises wherein I now reside together with the stable in the Occupation of Mr Marks Lamb as the said dwellinghouse and premises is now divided by a now built wall from the dwellinghouse and Premises lately sold by me to Mr Thomas Boucher and all other my real and personal Estate and Effects whatsoever and wheresoever the same may be at the time of my decease to hold to them the said Robert Young and Robert Jesty and the survivor of them his heirs Executors Administrators and assigns respectively Upon trust and confidence that my said trustees do and shall permit and suffer my wife Jane to have the use of all and singular my household Goods And Furniture and other Effects in my dwellinghouse and premises at the time of my decease or such part thereof as she shall think proper for and during the term of her natural life in case she shall so long remain unmarried and also upon further trust to pay and apply unto my said wife all the rents interest and produce of all the rest and residue of my said real and personal Estate to and for her own use and benefit for and during the term of her natural life in case she shall remain unmarried by even and equal quarterly payments but in case my said wife shall marry again then I do hereby revoke all such bequests to my said Wife and from thenceforth I hereby will and direct the same to be paid and applied in manner hereinafter expressed in case of her death but I do hereby direct that the provision hereby made for my said wife is and shall be in bar and lieu of all Dower and thirds which she might Claim or be entitled to of or from any Freehold Estate which I shall have been seized of or entitled unto at any time during my life and which I do hereby direct that she shall release and discharge within three months after my decease unto my said trustees or on refusal thereof I do hereby exclude her from all benefit under this my will and Testament and from and after the decease or Marriage again of my said wife Upon trust to convey pay and assign the same and every part thereof unto and for my Daughter Jane her heirs Executors Administrators and assigns providing always and it is my will that in case my said wife shall be desirous in her lifetime to raise and pay to my said Daughter any part or share of my said real or personal Estate and Effects then And in such case it shall and may be lawful for her so to do upon her testifying such desire in Writing unto my said wife trustees or the survivor of them his heirs Executors Administrators and assigns and in such case I hereby authorize them or him to raise the same by sale or mortgage of my said real or personal Estate as to them or him shall seem [most ?] and I do hereby empower my said trustees to reimburse and pay themselves all such losses Costs charges and expences which they or either of them shall sustain be put unto or expend in or about the trusts aforesaid and that they shall not be answerable or accountable for the acts deeds or default nor for the other nor for any more monies than shall respectively come to his her or their hands and lastly I do hereby nominate Constitute And appoint them the said Robert Young and Robert Jesty joint Executors in trust of this my last will and Testament hereby revoking and making void all former and other wills by me heretofore made and declaring this only to be my last will and Testament In Witness whereof I the said Testator Thomas Jesty have to this my last will and testament set my hand and seal this twenty sixth day of January in the Year of our Lord one thousand eight hundred and nineteen

Signed sealed Published and declared by the said Testator Thomas Jesty as and for his last will and Testament in the presence of us who at his request in his presence and in the Presence of each other have set our names as Witnesses

The Writing contained in this sheet of paper was this twenty fifth day of February 1819 republished and declared by the said Thomas Jesty the Testator to remain and be in force as his last will and Testament and we in his presence have signed our names as Witnesses thereto

Proved at London 4th July 1822 before the Judge by the Oath of Robert Jesty one of the Executors to whom Admi[nistrati]on was granted having been first sworn by Comm[issi]on duly to Adm[iniste]r power reserved to Robert Young the other Executor
