1727 Will of Susanna Gillard

This is the last Will and Testament of me Susanna Gillard of Yeovil in the County of Somerset Widow I give and bequeath two of my Gowns to my Niece Elizabeth Ring daughter of my late brother Robert Ring I give and bequeath such of the residue of my clothes and wearing apparel as my Executors hereinafter named shall think proper unto Ann the Wife of Peter Ring of Bradford Abbas in the County of Dorset and the residue of my said Clothes and wearing apparel I give and bequeath to the Children of my late brother Mark Ring to be delivered them in one month after my decease I give devise and bequeath unto my good Friends George Eason Elias Whitby (Glover) and Joseph Price (Linen Draper) all of Yeovil aforesaid all my freehold and leasehold Messuages Tenements Closes Lands Hereditaments and premises with their respective appurtenances and also all the Rest Residue and Remainder oof my personal Estate and Effects of what nature or kind soever or wheresoever the same may be at the time of my decease To hold to them the said George Eason Elias Whitby and Joseph Price their Heirs Executors administrators and assigns upon the trusts nevertheless and to and for the several [now and?] intents and purposes hereinafter mentioned expressed and declared of and concerning the same that is to same upon trust that they my said Trustees or the Survivors or Survivor of them or the Heirs Executors administrators and assigns of such Survivor do and shall as soon as conveniently may be after my decease either by public auction or private contract absolutely sell dispose of and convert into money all and singular my said freehold and leasehold Messuages Tenements Closes Lands Hereditaments and premises and my said residuary personal Estate hereinbefore devised and bequeathed unto any person or persons whomsoever for the most money or best price [word illegible] or prices that can or may be had or gotten for the same and do and shall receive and take the purchase money or purchase monies arising from the sale of my said real and personal Estate and the rents issues and profits thereof in the meantime and after paying and discharging all my just debts and funeral expense do and shall invest and place out the same on parliamentary or other good securities at interest and on payment thereof or of any part thereof to replace and put the same out on such other good securities in their own names or otherwise as they shall think proper and the dividends interest and profits thereof and every part thereof except the yearly sum of ten shillings hereinafter mentioned and bequeathed do and shall pay and apply unto and for the use and benefit of my only son William Jeanes during the term of his natural life in such manner in every respect as they my said Trustees or the Survivors or Survivor of them his Executors administrators or assigns shall in their discretion think proper and I hereby desire and empower my said Trustees or the Survivors or Survivor of them his Executors administrators and assigns of such Survivor to retain out of the said dividends interest and profits arising from the said sale as aforesaid such annual sum of ten shillings which I hereby direct to be paid during my said sons life to the Minister for the time being of the Baptist Meetinghouse in Yeovil aforesaid for my sons sitting in the said Meeting house and from and immediately after the decease of my said son upon trust that they my said Trustees and the Survivors or Survivor of them his Executors administrators and assigns of such Survivor do and shall call in the said principal monies arising from such sale or sales as aforesaid and pay and apply the same and every part thereof unto or for the benefit of all and every the children of my said son in equal shares and proportions if more than one Child and if but one then unto or for the benefit of such one but if my son shall die leaving no child then upon trust that my said Trustees and the Survivors or Survivor of them his Executors administrators and assigns do and shall in the first place pay out of the produce of my said real and personal Estate unto Miss Bridget Smith of Yeovil aforesaid Spinster the sum of nineteen guineas which I accordingly hereby give and bequeath to her unto the Children of my late brother Mark Ring the like sum of nineteen guineas which I accordingly hereby give and bequeath to them to be equally divided between them to my Nieces Keziah Ring and Elizabeth Ring the daughters of my late brother Robert Ring the like sum of nineteen guineas which I accordingly hereby give and bequeath to them unto my brother John Ring and my Niece Ann Ridout the daughter of the said John Ring the like sum of nineteen guineas which I accordingly hereby give and bequeath to them and unto my Niece Temperance Andrews the like sum of nineteen guineas which I accordingly hereby give and bequeath to her All the Rest Residue and Remainder of the monies arising from such sale or sales as aforesaid and I do hereby direct the said George Eason Elias Whitby and Joseph Price Trustees and the Survivors or Survivor of them his Executors administrators and assigns of such Survivor to pay and transfer unto the Trustees of the Calvinistic Baptists of the Yeovil Meeting house in Back Street in Yeovil aforesaid to be by them applied as they in their discretion shall think proper for the benefit of that sect meeting for the worship of God in that house and for the promotion of their religion under the superintendence and direction of the Minister Deacons and members for the time being and whereas I am seized of and well entitled unto certain closes of Land and premises situate in the parish of Yetminster prima alias Upbury probous being copyhold of inheritance held by me by Copy of Court Roll under the said Manor of Yetminster prima alias Upbury probous and whereas I have surrendered or do intend to surrender my said copyhold Close of Land and premises into the Lords hands To the use of my last Will and testament Now I do hereby give devise and bequeath the said copyhold closes of land and premises and every part thereof unto the said George Eason Elias Whitby and Joseph Price and the Survivor of them and the Heirs Executors administrators and assigns of such Survivor and I do accordingly hereby nominate and appoint the said George Eason Elias Whitby and Joseph Price to be the Lords next Tenants to the said Copyhold Closes of Land and premises To hold to them and the Survivors or Survivor of them and their and his Assigns according to the custom of the said manor upon the same trusts and to and for the same uses and intents and purposes as are hereinbefore mentioned expressed and declared of and concerning my real and personal property or as near thereto as the custom of the said Manor will admit and for facilitating such sale or sales as aforesaid my Will and I hereby declare that the receipt or receipts of the said George Eason Elias Whitby and Joseph Price or the Survivors or Survivor of them or the Executors administrators and assigns of such Survivor shall from time to time be a good and sufficient discharge or good and sufficient discharges to the purchaser or purchasers of all or any part of my said real copyhold or personal Estate and Effects and his her or their respective Heirs Executors administrators and assigns for so much of the said purchase money as shall be therein expended or acknowledged to be received and that such purchaser or purchasers his her or their Heirs Executors administrators and assigns or any of them shall not afterwards be answerable or accountable for any loss misapplication or nonapplication of such purchase money or any part thereof and it is my Will and I hereby declare that it shall and may be lawful to and for my said Trustees and the Survivors or Survivor of them or the Executors administrators and assigns of such Survivor by and out of all or any of the monies which by virtue of this my Will or any trust herein declared shall come to their or any or either of their hands to deduct retain and reimburse himself and themselves all such losses costs damages and expences as he or they shall or may respectively sustain expend or be put unto for or by reason of the trusts hereby in them respectively reposed or of the management and execution thereof or of any thing relating thereto and that they the said George Eason Elias Whitby and Joseph Price or the Survivors or Survivor of them or the Executors administrators and assigns of such Survivor shall not be answerable or accountable for any more monies than they shall respectively actually receive by virtue of this my will nor for any loss which shall happen of the said trust monies or any part thereof so as such loss happen without their wilful neglect nor the one of them for the other or others of them nor for the acts deeds receipts or disbursements of the others or other of them but each of them only for his own acts deeds receipts and disbursements only and I do hereby request my said Trustees to be the Guardians and overseers of my said Son during his present state of incapacity And lastly I do hereby nominate constitute and appoint the said George Eason Elias Whitby and Joseph Price joint Executors of this my last Will hereby revoking and making void all former and other Wills by me heretofore made and declaring this only to be my last Will and testament In witness whereof I the said Testatrix have to this my last Will and Testament contained in three sheets of paper to the first and second sheets hereof set my hand and to this last sheet my hand and seal the ninth day of February in the year of our Lord one thousand eight hundred and twenty seven

Proved at London 3rd January 1831 before the Judge by the oaths of Elias Whitby and Joseph Price the surviving Executors to whom administration was granted having been first sworn by Commission duly to administer
