1836 will of Thomas Jennings

Gentleman

 

This is the last Will and Testament of me Thomas Jennings of Yeovil in the County of Somerset Gentleman  First I direct that all my just debts and Funeral expences be paid and that I may be buried at Melbury Osmond in the County of Dorset as near to my Father and Mother as may be and that a head stone be erected to commemorate my death then I do give devise and bequeath unto my three Nephews John Jennings William Jennings and John Martin all living at Evershott in the said County of Dorset and to the survivors and survivor of them their and his Executors and Administrators all my Estate and Effects monies securities for money Goods and Chattels whatsoever and wheresoever situate in trust thereout to pay the sum of eight hundred pounds unto the Children of my late Sister Elizabeth Martin to be divided and distributed between them at the expiration of a year after my decease in equal portions as shall be living at the time of my decease and to the Children of any or either of them that shall then be dead such Children to be entitled only to their Father or Mothers part in equal portions such portion to be paid them when they arrive at the age of twenty one years or sooner if my Executors shall think proper then I give and bequeath the sum of eight hundred pounds unto the Children of my late Brother William Jennings to be divided and distributed between them at the expiration of a year after my decease in equal portions as shall be living at the time of my decease and to the Children of any or either of them that shall then be dead such Children to be entitled only to their Father or Mothers part in equal portions such portion to be paid them when they arrive at the age of twenty one years or sooner if my Executors shall think proper then I give and bequeath the sum of Two hundred pounds unto my Niece Sarah the Daughter of my late deceased Brother Robert Jennings and Widow of the late Mr Creasy of Boston to and for her sole use if living at my decease but if dead then I do give and bequeath the same unto her Children in equal shares and proportions and I direct that the last mentioned sum of Two hundred pounds shall be paid at the expiration of a year after my decease I give my great Nephew Thomas Robert Jennings my Watch Chain and seals thereto belonging and to the said John Martin I give my wearing apparel Linen and other [habiliments?] also I give unto Richard How of Yeovil aforesaid to his Wife and daughter and to their servant Mary Bradby a decent suit of mourning each all the Rest  Residue and Remainder of my Estate and Effects of what nature or kind soever I do hereby direct to be divided into three equal parts one third part of which I do give unto the Children of my said late Sister Elizabeth Martin in the same way manner and form as I have hereinbefore bequeathed to them the sum of eight hundred pounds as to one other third part of which I do give unto the Children of my late Brother William Jennings in the same way manner and form as I have hereinbefore bequeathed to them the sum of Eight hundred pounds and as to the remaining third part unto my said Niece Sarah the Daughter of my late deceased Brother Robert Jennings in the same way manner and form as I have hereinbefore bequeathed to them the sum of eight hundred pounds in the same way manner and form as I have hereinbefore bequeathed to her the sum of Two hundred pounds  And I do hereby appoint the said John Jennings William Jennings and John Martin joint Executors of this my Will hereby revoking all former Wills and Codicils by me at any time heretofore made I declare this to be my last Will and Testament In Witness whereof I have hereunto set my Hand and Seal this third day of January one thousand eight hundred and thirty six

Signed sealed published and declared by the said Testator Thomas Jennings as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as Witnesses

Proved at London 21st May 1836 before the Judge by the Oath of John Martin the Nephew one of the Executors to whom administration was granted having been first sworn by Com[missi]on duly to administer power reserved of making the like grant to John Jennings and William Jennings the Nephew also the other Executors when they shall apply for the same
