1838 Declaration of George Ewens

Respecting the possession of Penny’s Ground sold by Mr Penny to Mr Moody

I George Ewens of Yeovil in the County of Somerset Yeoman aged about eighty two years do solemnly and sincerely declare that I came to reside in the parish of Yeovil about sixty years ago and that for the space of Fifty eight years and upwards I have known and been well acquainted with the Close of Land commonly called Penny’s Ground situate adjoining the Mudford Road in Yeovil aforesaid and lately contracted to be sold by Henry Penny of Yeovil aforesaid Esquire to John Moody of Sherborne in the County of Dorset Excise Officer and that such Close of Land has during such period of Fifty eight years been in the possession of the said Henry Penny the present Owner and of his Father Henry Penny late of Yeovil aforesaid Glove Manufacturer deceased And I make this solemn Declaration conscientiously believing the same to be true and by virtue of the provisions of an Act made and passed in the fifth and sixth years of the reign of his late Majesty King William the fourth intitled “An act to repeal an act of the present Session of Parliament intitled An Act for the more effectual abolition of oaths and affirmations taken in various departments of the State and to substitute Declarations in lieu thereof and for the more entire suppression of voluntary and extra judicial Oaths and Affidavits and to make other provisions for the abolition of unnecessary oaths

This Declaration was made by the above named George Ewens of Yeovil in the County of Somerset this thirteenth day of October One thousand eight hundred and thirty eight before me And I do hereby certify that the above Declaration was first read over by me to the above named George Ewensand that he seemed perfectly to understand the same and make his mark thereto in my presence
