1853 will of Ebenezer wilson hughes

Commercial Traveller

 

This is the last Will of me Ebenezer Wilson Hughes of Yeovil in the County of Somerset Commercial Traveller I give All my personal property to Frederick Bollen of Saint Pauls Churchyard in the City of London Merchant and James Hughes of Plymouth Commercial Traveller and the survivor of them his executors and administrators In trust at his or their discretion to get in sell and convert into money the same or such parts thereof and at such times as they or he may seem expedient and to invest the proceeds thereof and my ready money on Government real or leasehold securities in England or Wales And with the consent of my Wife during her Widowhood and afterwards at their discretion to vary such securities And to be possessed of my said property In Trust after paying all current expences to pay the income therefrom unto my wife during her Widowhood for her support and the maintenance and education of my children And if my wife should marry again then to pay one third of such income to her during her life for her separate use And subject to the trusts aforesaid to transfer my residuary personal estate unto such child or children of mine living at my decease as shall attain the age of twenty one years or marry his her or their executors administrators and assigns if more than one in equal shares but in case all of my said children shall happen to die under the age of twenty one years without leaving lawful issue then upon trust to transfer my residuary personal estate unto my said wife her executors administrators and assigns absolutely And to apply towards the maintenance and education of each of my children the income from such childs presumptive share until his or her majority of marriage Provided that my trustees or trustee with the consent of my Wife or after her decease at their discretion may advance for the benefit of each of my children a moiety or less of such child's expectant share  I appoint the said Frederick Bollen and James Hughes to be my Executors revoking all former Wills I declare that if either of my trustees herein named or any person hereafter appointed to be a trustee of my Will should die or go to reside out of or be absent for a year from England and Wales or renounce or relinquish or refuse or be incapable to perform the office it shall be lawful for the other trustee or if there be no such trustee for the person so retiring or renouncing (being capable and willing to exercise this power) or if there be no such person for any executor or administrator of the trustee who shall then have last died in the office or if there be no such person for any my administrator to appoint any person or persons to be a trustee or trustees in the room of such first mentioned person  In witness whereof I have hereunto set my hand this eighteenth day of March one thousand eight hundred and fifty three

Proved at London 12th October 1854 before the Worshipful William Robinson Doctor of Laws and Surrogate by the oaths of Frederick Bollen and James Hughes the brother the Executors to whom Adm[inistrati]on was granted having been first sworn duly to administer
