This Indenture made the twentieth day of April one thousand eight hundred and ninety eight Between John Vincent of Bragchurch Yeovil in the County of Somerset Gentleman of the first part George Bird and Alfred William Pippard both of Yeovil aforesaid Builders of the second part and Caroline Rosa White (wife of Henry White of Yeovil aforesaid Cabinet Maker) of the third part Whereas by an Indenture dated the second day of September one thousand eight hundred and ninety two and made between the said George Bird and Alfred William Pippard of the one part and the said John Vincent of the other part the piece or parcel of land hereinafter described and intended to be hereby conveyed was with other hereditaments conveyed unto and to the use of the said John Vincent in fee simple by way of mortgage for securing payment to him of the sum of one thousand nine hundred pounds as therein mentioned And whereas the said George Bird and Alfred William Pippard have recently erected on part of the said piece or parcel of land a messuage or dwellinghouse and have laid out the remainder of such land as a lawn and garden and they have agreed with the said Caroline Rosa White for the sale to her of the said piece or parcel of land messuage or dwellinghouse and all other the hereditaments and premises hereinafter described and intended to be hereby conveyed and the inheritance thereof in fee simple in possession free from incumbrances at the price of five hundred and eighty pounds And whereas there is now owing on the security of the said Indenture a sum exceeding the said sum of five hundred and eighty pounds and upon the treaty for the said sale it was agreed that the sum of four hundred pounds should be paid to the said John Vincent out of the purchase money and he being satisfies that the balance of his mortgage debt is otherwise sufficiently secured has agreed to join in these presents in manner hereinafter appearing Now this Indenture witnesseth that in pursuance of the said agreements and in consideration of the sum of four hundred pounds to the said John Vincent paid by the said Caroline Rosa White on or before the execution of these presents by the direction of the said George Bird and Alfred William Pippard (the receipt of which sum the said John Vincent hereby acknowledges) and in consideration of the one hundred and eighty pounds to the said George Bird and Alfred William Pippard at the same time paid by the said Caroline Rosa White (the payment and receipt in manner aforesaid of which said sums or four hundred pounds and one hundred and eighty pounds making together the sum of Five hundred and eighty Pounds the said George Bird and Alfred William Pippard hereby acknowledge) The said John Vincent as Mortgagee by the direction of the said George Bird and Alfred William Pippard hereby conveys and the said George Bird and Alfred William Pippard as beneficial owner doth hereby convey and confirm unto the said Caroline Rosa White All that piece or parcel of land situate on the northern side of Park Road Kingston Yeovil in the County of Somerset containing in width against Park Road aforesaid twenty feet four inches or thereabouts and against the Roadway hereinafter referred to nineteen feet six inches or thereabouts and in length from North to South one hundred and fifty seven feet ten inches or thereabouts and bounded on the North by the said Roadway on the South by Park Road aforesaid on the East by a dwellinghouse and premises belonging to George Bird and Alfred William Pippard Together with the messuage or dwellinghouse and outbuildings erected on the said piece or parcel of land All which premises hereby conveyed are delineated and coloured Pink on the Plan drawn on these presents All walls and fences dividing the premises hereby conveyed from the adjoining premises on the East and West sides thereof to be deemed party walls and fences respectively the said Caroline Rosa White her heirs and assigns from time to time paying her and their proportion of the expense of maintaining the same Together also with full and free right and liberty for the said Caroline Rosa White her heirs and assigns owner and owners for the time being of the premises hereby conveyed and all persons authorized by her or them at all times hereafter for all purposes with or without horses carts carriages or other vehicles to pass and repass to and from the rear of the premises hereby conveyed from and to Park Road aforesaid over and along the Roadway coloured Brown and marked Roadway on the said Plan in common with all other persons entitled to use such a Roadway the said Caroline Rosa White her heirs and assigns paying from time to time her and their proportion of the expense of keeping such Roadway in repair To hold the premises hereby conveyed unto and to the use of the said Caroline Rosa White in fee simple absolutely discharged from all principal money and interest secured by and all claims and demands under the hereinbefore recited Indenture And the said John Vincent hereby acknowledges the right of the said Caroline Rosa White to production and delivery of copies of the documents mentioned in the schedule hereto And the said George Bird and Alfred William Pippard hereby jointly and severally covenant with the said Caroline Rosa White her heirs and assigns an undertaking for the safe custody of the said documents and that with such undertaking shall be given they or he shall be subject to the same obligations in all respects as if such undertaking had been given In witness whereof the said parties to these presents have hereunto set their hands and seals the day and year first above written
