1831 will of George Brailey

This is the last Will and Testament of me George Brailey of Yeovil in the County of Somerset Cordwainer made this ninth day of June one thousand eight hundred and thirty one I give and bequeath unto my Grandson William Brailey my Watch I give and bequeath unto my daughter Sarah the sum of one hundred pounds Sterling to be paid her within six Months next after my decease And as to all the rest and residue of my Estate and Effects of what nature or kind soever the same may be or consist at the time of my decease I give and bequeath the same unto George Wellington of Yeovil aforesaid Chemist and Druggist and Elias Whitby the Elder of the same place Glove Manufacturer and to the survivor of them and the Executors and Administrators of such survivor Upon Trust to make Sale and convert into money all such parts thereof as may be Saleable and collect and get in all such sum and sums of money as shall be due and owing unto me from any person or persons whomsoever and after payment of all my just debts Funeral and Testamentary expences Upon Trust to pay and make over the same unto and amongst all and every such Child or Children of my Son Thomas Brailey as shall be living at my decease in equal shares and proportions if they shall have attained the age of twenty one years or otherwise to those that have and to the other or others of them as they respectively attain that age And the share or shares of him her or them not having attained their said age of twenty one years Upon Trust in the meantime and until they shall attain that age to place out and invest the same in or upon any of the Parliamentary Stocks or Funds of this Kingdom or at Interest upon such Security as they my said Trustees or the survivor of them or the Executors or Administrators of such survivor shall think fit and do and shall pay and apply the Interest dividends and annual produce thereof for and towards the maintenance education and support of such Child or Children of my son's Son Thomas whose share or shares shall not then be payable under this my Will and until they shall attain his her or their said age of twenty one years And I do hereby declare and direct that if either of the Children of my said Son Thomas living at my decease shall happen to depart this life before his or her original share of the residue of my said Estate and Effects shall become payable under this my Will then the share of him or her so dying shall be paid and applied by my said Trustees or the survivor of them or the Executors or Administrators of such survivor unto for and amongst the survivors or survivor of the said Child or Children of my said Son Thomas living at my decease and if there shall be no such Child of my said Son Thomas who shall attain his or her age of twenty one years Then I direct that my said Trustees or the survivor of them or the executors or administrators of such survivor do and shall stand possessed of and interested in the said trust monies Stocks Funds and Securities upon Trust to pay and make over the same unto the then nearest of kin or legal Representative of my said Son Thomas Brailey and upon no other Trust whatsoever And I do hereby further declare it shall be lawful for my said Trustees or the survivor of them or the Executors or administrators of such survivor to pay any debts claimed from any Estate upon any evidence they shall think proper to admit and to adjust settle compromise and compound and debt or debts owing to me and to allow such time for the payment thereof as to him or them shall seem reasonable and my Will is and I do hereby expressly declare that my said Trustees or the survivor of them or the executors or administrators of such survivor shall not be charged or chargeable with or accountable for more monies estate and effects than he or they shall actually receive or shall come to his or their respective hands by virtue of this my Will nor with or for any loss which shall happen thereto or of any part thereof so as such loss happen without their wilful default or neglect not the one for the other of them or for the acts debts receipts defaults or disbursements of the other of them And the receipt or receipts of my said Trustees or the survivor of them or the executors or administrators of such survivor for any money payable to him or them respectively by virtue of this my Will shall be an effectual discharge and discharges to the person or persons paying the same and also that it shall be lawful for my said Trustees and the survivor of them and the executors and administrators of such survivor in the first place to deduct and reimburse himself and themselves respectively all such loss costs charges and expences as he or they shall sustain expend or be put unto for or by reason of the performance of this my Will or the Trusts hereby in them reposed or the management and execution thereof respectively or any other thing in anywise relating thereunto And lastly I do hereby nominate constitute and appoint the said George Wellington and Elias Whitby the elder Executors in Trust of this my Will hereby revoking and making void all former and other Wills by me at any time heretobefore made and do declare this to be my last Will and Testament In Witness whereof I have to the two preceding sheets hereof set may and and to this third and last sheet my hand and seal and my seal at the top of the said sheets where all the said sheets are fixed together the day and year first written

The writing contained in this and the two preceding sheets of paper was signed and sealed by the above named George Brailey and by him published and declared as and for his last Will and testament in the presence of us who in his presence and at his request and in the presence of each other have hereunto subscribed our names
